Learn More About Mediation
What is Mediation?
Mediation is a voluntary and confidential process. An independent mediator assists both parties to a dispute to generate options for resolving their issues in a settlement that works for both sides. You are in complete control of the decision to settle and the terms of the resolution. It’s an opportunity for all concerned to achieve an acceptable outcome without the need for litigation.
Regan Peggs provides mediation services for a range of disputes:
Mediation is a constructive process to rebuild trust. You can resolve your civil dispute with a settlement and avoid an uncompromising court-imposed decision.
Commercial disputes and deadlocked negotiations don’t benefit either party. Mediation provides a fast and affordable way to find a way forward.
Mediation is a simpler, less stressful way to resolve family disputes. You can maintain family relationships with an agreement that is acceptable to all involved.
Internal conflict is damaging to everyone affiliated with your firm. Mediation helps to clear the air and find a solution that is satisfactory to all parties.
Tenancy disputes are costly and time-consuming. It’s in the interest of both landlord and tenant to reach an agreement and avoid the litigation process.
Why Choose Mediation?
- Cost-Effective – It’s significantly more affordable than proceeding with litigation.
- Fast – It can be arranged quickly and result in a much speedier resolution than going to court.
- Control – You can negotiate a settlement that works for both parties rather than having a decision imposed.
- Confidential – Everything discussed during mediation remains confidential.
- Maintain Relationships – Reduces friction between parties and achieves a mutual agreement on how to move forward.
- High Success Rate – 70% of family cases and 93% of commercial cases result in settlement.
Even if you cannot reach a settlement, the mediation process can lead to a better mutual understanding between parties. It can narrow the issues for the court process.
How to Start Mediation
Step 1 – Make an Enquiry
The first step is to schedule an initial consultation. This is a confidential discussion at no cost to see if a mediation service is right for you.
Step 2 – We Arrange a Date With Both Parties
If both parties agree to proceed, we’ll create an Agreement to Mediate. This sets out the rights and responsibilities of the mediator and confirms both parties have the authority to settle. We’ll then arrange a date and location for an in-person or online mediation.
Step 3 – The Mediation Session
You’ll have the opportunity to explore possible solutions and attempt to resolve the conflict through joint and individual discussions with the mediator. The session is held in a neutral location, and everything discussed is confidential. If you reach an agreement, the mediator will provide a written document detailing the settlement terms for you to formalise into a legally binding agreement.
