How can we help you?

Health and Safety Investigations

When an accident occurs in the workplace, it can be investigated and prosecuted by a government agency known as the Health and Safety Executive (HSE).

During an investigation, HSE investigators will thoroughly scrutinise every aspect of your operating procedures. Even where no fault is found in relation to the initial accident, the HSE will often find other matters of concern.

With copious experience and an excellent track record in dealing with the HSE at this stage of their investigations, we can help you in a number of ways:

  • We can be present at any formal interviews with directors or members of staff, in order to protect them and your business.
  • If some fault is found, we may be able to persuade the HSE to issue a caution rather than prosecute at court.
  • If the HSE decides to prosecute, we can provide you with a robust defence and deal with the extensive paperwork involved.
  • Should your case attract press attention, which is common for HSE prosecutions, we can help you to avoid or mitigate adverse publicity and minimise reputational damage to your business.

Environmental Offences

Environmental offences are taken increasingly seriously by the courts, with sanctions often involving fines of up to £3 million for companies, or three years’ imprisonment for individuals.

As such, a prosecution for an environmental offence can be potentially devastating for a business or an individual, so expert advice should be sought as soon as an incident occurs.

During an investigation, you can expect thorough scrutiny of every aspect of your operating procedures. Even small oversights or gaps in procedures can lead to action being taken.

Should you find yourself or your business under investigation for an environmental offence, we can help you in a number of ways:

  • We can be present at any formal interviews with directors or members of staff, in order to protect them and your business.
  • If some fault is found, we may be able to persuade the investigators to issue a caution rather than prosecute at court.
  • If a prosecution is brought, we can provide you with a robust defence and deal with the extensive paperwork involved.
  • Should your case attract press attention, which is common for environmental prosecutions, we can help you to avoid or mitigate adverse publicity and minimise reputational damage to your business.

Trading Standards Violations

Trading Standards rules cover a wide range of areas and are enforced by officers who often work closely with the police.

When an offence is alleged, even blameless defendants can say the wrong thing and find themselves suffering a lengthy investigation.

We can help right from the start of the process, providing legal advice to avoid prosecution entirely, or by representing you at court should the case progress.

Food Safety Investigations

Food safety investigators are employed by local authorities to investigate complaints of contamination, rodent infestation, poisoning and other hygiene or safety matters. They also have the power to carry out unannounced inspections of premises.

Where inspectors find a problem with premises the first thing they will often do is serve a prohibition notice, combined with an improvement notice. This means that you will have to close your business until you can satisfy the inspectors that you have addressed their concerns.

For every day your business is closed you are losing money and risking having to shut your business down entirely. We can help you to minimise this closure period, by negotiating with the relevant officers about which of the items listed in the improvement notice must be completed before you can re-open and which can be carried out in the following weeks or months.

Occasionally, prohibition notices are incorrectly or unlawfully imposed. If you think this has happened to you, please contact us straight away as they can be challenged, but time is of the essence.

Once the initial difficulties are resolved, there will usually be a full investigation, during which investigators will thoroughly scrutinise every aspect of your operating procedures. Even small oversights or gaps in procedures can lead to action being taken.

Should you find your business under investigation, we can help you in a number of ways:

  • We can be present at any formal interviews with directors or members of staff, in order to protect them and your business.
  • If some fault is found, we may be able to persuade the prosecutors to issue a caution rather than prosecute at court.
  • If a prosecution is brought, we can provide you with a robust defence and deal with the extensive paperwork involved.
  • Should your case attract press attention, which is common for food safety prosecutions, we can help you to avoid or mitigate adverse publicity and minimise reputational damage to your business.
